Advertisement:
The leaflet stated “Newcastle fm €38.99 one way inc. taxes. Jet2.com. Friendly low fares fm Cork.”

Complaint:
The complainant considered the brochure misleading as he said that he was unable to avail of the price advertised of €38.99. He purchased flights to Newcastle from Cork on 28th May 2009 and his travel date was 29th May 2009.

The Secretariat forwarded the complaint to the advertisers and in addition they provided the advertisers with a previous adjudication which provided that advertisers must be in a position to demonstrate that at least 10% of tickets advertised should be available at the lead-in price. Therefore they also requested the advertisers to provide information regarding the percentage of tickets available at the lead-in fare.

The advertisers provided screen shots of fares available at the lead-in fare and stated that for the duration of the campaign the percentage of fares available at this price comfortably exceeded the minimum 10% requirement.

They also explained that from the screen shots submitted by the complainant it was evident that the complainant had booked his flights a day prior to travel. They said that airfares generally increase the closer to the actual travel date the flight was booked and also the fact that the particular weekend in question was a UK public holiday would mean that the flight prices would generally be higher due to increased demand.
Conclusion
Complaint Not Upheld.

The Complaints Committee considered the detail of the complaint and the advertisers’ response. The Committee noted that the advertisers provided information in relation to the availability of the lead-in from fare and that in excess of 10% of the seats advertised were available at this price. They also accepted that it was normal to expect an airfare to increase the closer to the travel date the flight was booked. They noted that the complainant had booked his flights one day prior to travel on a UK public holiday weekend. They did not consider the advertisement misleading.
