A point-of-sale display in a Pandora store stated:
Spend €109 and receive a free bracelet worth €69*
LIMITED TIME ONLY
*Whilst stocks last”
The complainant considered that the point-of-sale material advertising the offer was misleading. The complainant purchased a voucher for €110 and had expected to receive the free bracelet, however, they were advised that the offer only applied to the purchase of jewellery and not to vouchers. The complainant noted that no reference had been made to any terms and conditions of the offer on the promotional material and was advised by staff that it had been omitted in error.
The advertisers failed to provide a response to the complaint.
The Complaints Committee considered the detail of the complaint. The Complaints Committee expressed concern at the advertisers’ failure to respond to the complaint. They reminded them that there is an onus on advertisers to ensure that their advertising is in conformity with the Code.
The Committee noted the requirements of the Code and considered that the exclusion of a notification that terms and conditions existed, particularly that the purchase of vouchers was excluded, was in breach of the Code. On that basis and in the absence of a response, the Committee considered that the advertising was in breach of Sections 3.10, 4.1, 4.4, 5.5, 5.16 and 5.17 of the Code.
The advertising should not appear in its current form again.
