The complainant said she purchased the unlimited free texts with a monthly subscription bundle. When she tried to use the unlimited national texts, her account was blocked from texting. She believed the offer of unlimited texts was not a true offer.
The advertisers failed to provide a response to the complaint.
The Complaints Committee considered the details of the complaint. The Complaints Committee expressed concern at the advertisers’ failure to respond to the complaint. They reminded them that there is an onus on advertisers to ensure that their advertising is in conformity with the Code.
The Committee noted that substantiation for the claim had not been provided. In the absence of a response from Lyca Mobile the Committee concluded that the advertising was in breach of Sections 3.10, 4.1, 4.4, 4.9 and 4.10 of the Code.
The advertisement must not reappear in its current form.
